Course terms

These are the terms and conditions of Happy Parents Happy Baby Ltd, a company registered in England and Wales under company number 11236735 with its registered office at 34 Clarence Street, Southend-On-Sea, England, SS1 1BD (“Happy Parents Happy Baby”, “we”, “us” or “our”). These terms explain the terms under which you may book and attend our courses. By booking a course, you agree to be bound by these terms, our website terms, and our privacy policy, and if you do not agree to comply with these terms, you should not book a course. 

1. YOUR BOOKING

The cost of the Happy Parents Happy Baby in person course includes admission for up to two people. For insurance purposes, anyone attending must be registered at booking. 

All prices are stated in GBP and include VAT (where applicable). 

All payments must be made in full at the time of booking via our website. We reserve the right to cancel bookings in the event of payment reversal or suspected fraud. On receipt of your payment, we will send you a confirmation email. A legally binding contract is formed between you and Happy Parents Happy Baby when we send you the booking confirmation email. Happy Parents Happy Baby reserves the right to decline or refuse any application to attend its classes at our discretion. 
Happy Parents Happy Baby courses run with a minimum of four and up to fourteen bookings. A minimum of four bookings is required for a course to proceed. We reserve the right to cancel a course at any time should minimum numbers not be met, or due to other unforeseen circumstances. In such cases, we will email you to offer you a suitable alternative course (subject to availability), or a full refund of the booking fee.

In the event of an act of nature such as severe weather conditions e.g. heavy snow or a pandemic, where personal safety could be compromised we reserve the right to transition your course to an online format. Refunds or discounts will not be provided. 
The cost of your booking does not include any food or drink at the venues (including for the social sessions). We would recommend that you eat before coming to each of the sessions. 

2. CHANGING YOUR BOOKING

You may request to change your in person course location at any time before the course starts, subject to availability, by emailing us at bookings@happyparentshappybaby.com. If you transfer to a higher-priced course, you will be required to pay the difference. If the new course is lower in price, we will refund you the difference, minus a £5 transaction fee. We cannot facilitate course transfers once a course has started. 

You can cancel your Happy Parents Happy Baby in person antenatal course up to six weeks before your course is due to start by emailing us at bookings@happyparentshappybaby.com. You will be refunded the amount you paid, minus a £25 cancellation fee (which represents our reasonable expenses in cancelling your booking). If you wish to cancel less than six weeks before the start of the course, or during the course, no refund will be given unless there is an exceptional circumstance.

We reserve the right to refuse multiple or repeated booking changes or cancellations made in bad faith.

Exceptional circumstances

Refunds will be processed for exceptional circumstances that would prevent you from attending all remaining sessions of the course. Refunds will not be processed for individual missed sessions during the course, even due to exceptional circumstances.

Exceptional circumstances include:

  1. A medical condition, as evidenced by a doctor’s note

  2. Your baby arriving before 37 weeks of pregnancy

  3. Bereavement related to your pregnancy, that would prevent you from attending all remaining sessions of the course.

You will not be entitled to any refund if you miss sessions due to your baby arriving after 37 weeks of pregnancy. 

If you wish to apply for a refund, this must be done within three months of the finish date of the course you were enrolled on, and you must email us at bookings@happyparentshappybaby.com. We cannot process refunds for any reasons after this time. 

We may request supporting documentation to assess any claim for a refund under exceptional circumstances, and our decision will be final.

Processing refunds

Refunds will be processed within 7 working days of being agreed by Happy Parents Happy Baby. Refunds will only be made to the original payment method used at the time of booking, unless agreed otherwise in writing.

Moving house

Moving house is not considered an exceptional circumstance. You may request to change your in person course location at any time before the course starts, subject to availability, and subject to you emailing us at bookings@happyparentshappybaby.com. If you transfer to a higher-priced course, you will be required to pay the difference. If you wish to cancel your course with six or more weeks’ notice, we will offer you a refund, minus a £5 transaction fee (which represents our reasonable expenses in cancelling your booking). If you cancel less than six weeks before the start of the course no refund will be given but we will offer a transfer onto our online course.

3. UNFORESEEN CIRCUMSTANCES

In the unlikely event that Happy Parents Happy Baby needs to reschedule the date or time of a course session, you will be notified via email with as much advance notice as possible. If you are unable to attend the rescheduled session because it was not one of the dates in your original booking, we will offer a suitable alternative or provide a pro rata refund for the missed session. This does not include where we need to change the order of the sessions.  

Happy Parents Happy Baby uses third party venues. As such, we cannot be held liable for any actions, omissions, cancellations or issues with our hosting venues. If we need to change course venues, we will use reasonable endeavours to find an alternative within 2.5 miles (as the crow flies) of the original, however we cannot make any guarantees that this will be possible. In these circumstances no refund will be offered where you are unable to attend the alternative venue.

In exceptional circumstances, we may need to cancel your course booking. Should this occur, we will notify you by email and we will make every effort to offer a suitable alternative. If you choose not to accept the alternative, a full refund will be provided.

We do not accept responsibility for travel or accommodation costs incurred as a result of rescheduling or cancellation.

Please add bookings@happyparentshappybaby.com to your safe emails. We cannot be held liable for you missing rescheduled sessions due to you not reading our emails. 

4. MISSED SESSIONS

If you are unwell or have symptoms of an infectious illness, such as cold, flu, norovirus, we ask that you stay at home to rest and recover in accordance with NHS guidelines. Out of courtesy to other attendees, please do not attend an in person session if you have infectious symptoms. As we have a duty of care to all attendees, we reserve the right to ask anyone with obvious infectious symptoms to leave the session. 

We are unable to facilitate session swaps or Zoom dial-ins if you need to miss a session. However, you can catch up with any missed material on our course portal. Your course host and our online specialists will also be able to answer any questions you have, so that you feel confident you have covered all the course material.

We are unable to refund missed sessions under any circumstances. If you are likely to miss more than one session, we recommend you consider rescheduling your booking in advance.

5. DISCOUNTS

Only one discount can be applied per course booking, and it must be added at the time of booking. We are unable to provide refunds for discounts that were not available at the time you booked, but subsequently become available. Please be wary of using discount codes online. We reserve the right to cancel your course place if discount codes have been distributed outside of agreed terms. We also reserve the right to withdraw any discounts we offer without prior notice and we will not be liable for the consequences of this.

6. COOLING OFF PERIOD​

As you are a consumer and have booked our course online, you have the legal right to cancel your booking within 14 days of receiving your booking confirmation email. This is your “cooling-off period”. If you cancel within this period, you are entitled to a full refund.

If your course begins during the 14-day cooling-off period, and you attend one or more sessions or access any course materials, you will not be eligible for a refund. 

Once the course is complete, your right to cancel under the cooling-off period no longer applies.

To cancel your booking during the cooling-off period, please email us at bookings@happyparentshappybaby.com with your name, booking reference, and confirmation that you wish to cancel under your statutory rights. 

7. KEEPING YOU SAFE​

Happy Parents Happy Baby takes your health and safety seriously. 

We conduct thorough risk assessments and adhere to safe operating procedures at all our venues to ensure your safety. We are also covered by public liability insurance.  

We aim to ensure an enjoyable course experience for everyone and kindly request that all participants treat the host and fellow course attendees with respect. We reserve the right to offer an alternative provision or cancel any booking if behaviour expectations are not upheld.

If you feel unwell whilst at a session you should immediately seek advice from a health professional. Please do not ask for personalised medical advice from the Happy Parents Happy Baby team as we will be unable to provide it. 

Disruptive, abusive or inappropriate behaviour (including towards staff, facilitators or other attendees) may result in your removal from the course without a refund.

8. DISCLAIMER​

Happy Parents Happy Baby classes are led by qualified health professionals. All course materials are developed to be current and factually accurate at the time of delivery, in line with NHS-approved professional standards. The information provided is intended for educational and guidance purposes only and should not replace advice from your own medical team.

Participation in Happy Parents Happy Baby courses is at your own risk. We accept no liability for any injury, loss, or damage suffered during or as a result of your participation in our courses. Attendees are responsible for their own physical wellbeing, and we advise you to consult your healthcare provider before participating in any course activities.

While we are here to support you, we cannot offer personalised medical advice regarding your pregnancy, birth, or baby. Any health-related concerns must be directed to your healthcare provider, who holds overall responsibility for your care. We cannot be held liable for decisions made based on information from our courses or materials. Please take responsibility for your own wellbeing and only engage in activities you feel comfortable with.

A summary of the course content is available on our website. We reserve the right to make changes to the content or substitute facilitators, if necessary. In the event we are unable to deliver a course in person due to circumstances beyond our control, we may provide the course virtually via video call. No refunds will be issued in such cases.

Happy Parents Happy Baby accepts no responsibility for loss, damage, or injury to any person or property arising from participation in our courses or reliance on the information provided. Attendees are responsible for their personal belongings during sessions.

9. COPYRIGHT AND COURSE MATERIALS​

All materials provided through Happy Parents Happy Baby courses and published on our website and course portal are protected by copyright and other intellectual property laws. These materials are owned by Happy Parents Happy Baby or its licensors, and all rights are reserved. You may download or print extracts for your personal use only. Any other use, including commercial use, modification, or redistribution, is strictly prohibited without our prior written permission. You may not alter any printed or downloaded materials in any way, and all illustrations, photographs, videos, audio clips, or graphics must be used only in conjunction with the accompanying text. You may not take photos of the materials used in the in person sessions. All materials must retain appropriate attribution to Happy Parents Happy Baby and any identified contributors. Any unauthorised use of our materials (including sharing login details or downloads with others) will result in immediate suspension of access and may lead to legal action. Breach of these terms will result in the immediate termination of your right to use the materials, and/or legal action against you. 

10. ACCESSIBILITY ​

Happy Parents Happy Baby aims to make courses accessible for all. Please email bookings@happyparentshappybaby.com at the time of your booking to discuss how we can support you. 

We do not provide British Sign Language (BSL) interpreters, but you are welcome to arrange for an interpreter to attend.

11. ANIMALS​

Assistance dogs are welcome at course sessions. However, we kindly ask that you do not bring other pets, as some attendees may have allergies or phobias. For the comfort and safety of all participants, we reserve the right to refuse entry if non-assistance animals are brought to the session.

12. PHOTOGRAPHY​

We occasionally take photographs/videos during courses sessions, which we may use for promotional purposes including on our website or social media channels. Appearing in these photographs/videos means that we are processing your personal data and we rely on our legitimate interests as the lawful basis under UK GDPR for processing photography and video for promotional use. If you do not consent to this, please let us know in advance by emailing us at bookings@happyparentshappybaby.com. We will take reasonable steps to ensure you are not included in such content if you withdraw consent.

13. COMPLAINTS​

If you are dissatisfied with any aspect of your course, we kindly request that you notify us by email to bookings@happyparentshappybaby.com within 48 hours of the session to allow us to rectify the issue as soon as possible. 

Please note that we are unable to offer refunds for concerns raised after the course has concluded, where no opportunity has been given for us to put things right.

14. LIMITATION OF LIABILITY​

Happy Parents Happy Baby will not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss, claim, damage or expense, or for any indirect or consequential loss arising out of or in connection with any contract between you and us, or for any damage to property or person (unless caused by our negligence).

Except to the extent expressly set out in this section, the terms implied by Sections 13 to 15 of the Sale of Goods Act 1979 and by Sections 3 to 5 of the Supply of Goods and Services Act 1982 are excluded.

Nothing in these terms seeks to limit or exclude our liability for: (a) death or personal injury caused by our negligence (including that of our employees, agents or subcontractors); (b) fraud or fraudulent misrepresentation; (c) breach of the terms implied by Section 12 of the Sale of Goods Act 1979 or Section 2 of the Supply of Goods and Services Act 1982; (d) any other matter in respect of which liability cannot be excluded or restricted by law. 

Our total liability to you for all other losses arising out of or in connection with the contract for sale between you and us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to directly foreseeable loss.

15. GENERAL LEGAL TERMS​

Force majeure: Where an event outside our control occurs, this is a “force majeure event” and includes, but isn’t limited to, storm, fire, earthquake, an act of God, a natural disaster, a failure of electricity or power supplies, epidemic, pandemic, government rules, regulations or guidance, or a failure of a third-party supplier to do as they are contracted to do. Where a force majeure event occurs, we are excused from performance under these terms, and we won’t be liable to you for our failure to perform. We will use our reasonable efforts to continue our obligations under these terms as soon as we are able to after the force majeure event has stopped. If a force majeure event continues for more than 30 days, either party may terminate the contract with immediate effect by giving written notice to the other.

Data Protection: We comply with applicable data protection legislation, including the retained EU law version of the General Data Protection Regulations ((EU) (2016/679) and the Data Protection Act 2018. We will only use your personal information as set out in our privacy policy and our cookie policy. 

Notices: Any notices to be served on each other (save those in relation to the service of legal proceedings) must be sent by email and the time of delivery will be the time of transmission. Please send any notices to us by email to bookings@happyparentshappybaby.com and we will use the email you provide to us when you make your booking. If your contact details change, please let us know. 

Conflicting terms: Should there be any conflict between these terms and payment gateway, these terms shall prevail.

No waiver: No failure or delay by us in exercising any of our rights under these terms shall be deemed to be a waiver of that right, and no waiver by us of a breach of any provision of these terms shall be deemed to be a waiver of any subsequent breach of the same or any other provision.

Severance: In the event that one or more of the provisions of these terms is or are found to be unlawful, invalid, or otherwise unenforceable, that or those provision(s) shall be deemed severed from the remainder of these terms. The remainder of these terms shall be valid and enforceable.

Survival: Any provisions which by their nature should survive termination of this agreement shall do so, including but not limited to those relating to intellectual property, limitations of liability, and governing law.

Entire agreement: These terms and any other document specifically referred to herein contains the entire agreement between us and you with respect to its subject matter and formation. These terms supersede and extinguish any and all previous agreements, representations, warranties, promises, assurances, and understandings between us and you relating to its subject matter and formation.

Third party rights: Unless it expressly states otherwise, these terms do not give rise to any rights under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these terms.

Applicable law: These terms and any non-contractual obligations arising hereunder, shall be governed by, and interpreted according to English law and all disputes arising under these terms (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English courts.
